DETROIT, MI – Two Michigan gun rights advocate groups argued their case for being allowed to openly carry guns on school property in front of a three-judge Michigan Court of Appeals panel on Tuesday, Dec. 13, in Detroit.

Michigan Open Carry Inc. and Michigan Gun Owners Inc. faced off against Clio Area School District and Ann Arbor Public Schools, respectively, in two similar cases front of Court of Appeals Judges Kirsten Kelly, Elizabeth Gleicher and Douglas Shapiro.

Both cases stem from the school districts’ attempts to effectively ban guns from school property. The Court of Appeals now seeks to answer whether the schools had the authority to do so after the two cases received differing decisions from lower courts.

In August 2015, Genesee County Circuit Court Judge Archie Hayman ruled to allow Kenneth Herman, a concealed pistol license holder, to legally open carry his pistol inside of his daughter’s Clio area elementary school, despite the district declaring its properties to be weapon-free zones and banning him from doing so.
