A 40-year-old man in Tuscaloosa, Alabama shot and killed his 82-year-old father, but he will not likely face any charges. Police believe it to be a case of self defense.

According to the Tuscaloosa News report, the father, Archie McDaniel, was very likely suffering from dementia. Captain Kip Hard, homicide assistant commander,  believes this is what caused the elderly man to threaten to kill his son, before firing a shot that grazed him, and then turning his weapon on his other son.

Tuscaloosa News reports:

 

“Based on everything we know right now, everything appears to have been justified,” he said.

The trouble started Sunday night when McDaniel threw some items into the yard of his brick home on Hargrove Road East near Woodland Road. His sons live in homes on either side.

His younger son, 40, pulled into the driveway to retrieve the items around 6:45 a.m., Hart said. He didn’t realize that his father was outside and armed.

“Mr. McDaniel confronted him with a handgun and threatened to kill him. He fired a shot that grazed him,” he said.

The older son came outside and attempted to calm his father, Hart said.

“Mr. McDaniel turned and pointed the weapon at that son,” he said. “Unfortunately, the other son had to shoot to protect himself and others at the scene. They tried to de-escalate it as best they could, up to a point where they were not given a choice and had to do what they had to do to protect themselves.”

This is a sad story and it must have been terribly hard for the son who’s hand was forced in defense….However, it sounds like it was a necessary action. If the son had not taken action, then he and his brother could likely be dead right now.
