Many ideas and pieces of legislation sound good on the surface, but when you take a harder look at the idea, you often find just how dangerous the idea can really be.
This describes a bill that state Rep. Todd Stephens (R-Montgomery) plans to introduce into the Pennsylvania state legislature.
In response to the failure to act upon the warning signs seen in advance of the Florida school shooting, Stephens’ bill would allow family members and the local DA to determine if a family member poses an extreme risk to others and consequently, confiscate all of the person’s firearms.
Sounds good on the surface, but it has a dangerous side.
(Gant Daily) – Rep. Todd Stephens (R-Montgomery), a former federal firearms prosecutor, has announced that he will introduce legislation to help families and law enforcement to better prevent suicides and gun violence. Stephens’s bill would create an Extreme Risk Protective Order (ERPO).
“It is clear that we must do more to address the issues arising from those with mental health issues who pose a threat to themselves or others,” Stephens said.
“We must create a way for family members or law enforcement to ask a judge to temporarily prohibit certain individuals from possessing firearms or ammunition, and to relinquish any firearms or ammunition they may currently have, to prevent them from doing harm.”
The ERPO would allow a court to take the precautions necessary when provided with clear and convincing evidence the subject poses an extreme risk to him or herself or others…
The dangerous thing about a bill like this is known as revenge. How often have you seen a couple, married or not-married have a very bad breakup? In their anger and hatred, they make all kinds of accusations, some true and some false. A bill like this could be used by an any angry partner to get even with the other by making accusations of abuse, anger, threats, etc., just to get officials to take away the person’s guns, which in many cases, becomes a permanent ban from gun ownership. Like the waters in a Louisiana swamp, the surface looks great, but underneath, lies all kinds of dangers and the same is true with kind of bill.
